Fact-finding Report on “Inhuman and Ruthless Torture of an accused   by Jail staff in Choudwar Jail, Cuttack of Odisha
              
Background
On 17th May, 2017, there was news in Sambad News paper about brutal attack on an accused in Choudwar jail and his hospitalisation on S.C.B. Medical, Cuttack. The background story of the incident which was published in Sambad is that on 9th May,   at 11 PM the Malgodam police arrested Bapi alia Saroj Das of Ranihata Dasa Sahi area of Cuttack town in a police case of 2002 incident in which Bapi was accused. He was produced before Court on 10.5.17 and forwarded to Choudwar Jail.  On 12.5.17., his wife Budhei Das visited to Jail to meet him but not allowed.  On 13.5.17, she was informed about hospitalisation of her husband. She found her husband under unconscious stage with multiple injuries throughout his body............................

Visit of the Team
Having  been perturbed over the news  about such inhuman and barbaric attack on a defenceless accused,  a four-member Fact-finding Team of Civil Society Group  visited  S.C.B. Medical, Cuttack on 19.5.17  at 1 PM  to ascertain  the fact , reason of torture from accused ‘s mouth  and treatment rendered to him, support, if any required  for him in order to provide justice to him and his family. The Team members were as follows.

The Team was enlightened   about treatment of accused Sri Saroj Das in Haematology Dept. of S.C.B.Medical. Accordingly, the Team members reached in Ward No.2 of Dept.  and found Saroj lying on bed with saline connection. His wife Budhei Das was standing beside the bed. The members looked at the whole body and came across multiple injuries in his body. His eyes are found yellowish. On query, her wife responded that  he was suffering from jaundice even before arrest. It was felt that this disease has got aggravated due to lack of proper treatment of the accused in Jail. Then the Team members interacted with Saroj to understand the reason of torture and merciless attack on him. He shared in thundering tone that he was having no injury on his body prior to being   referred to jail. On 12th May, his wife met him at 5 pm and appraised him about a bag containing some clothes and Rs. 100.00 given to Jail staff to hand over to him.  After   his wife left, he asked  Jail staff for bag. While looking at bag,   100 rupees note was not found there.  Saroj, accused asked Jail staff about 100 rupees note.  Finding no response, Saroj asked them repeatedly to return the money. Being enraged they started beating him mercilessly using very slang language. As he was suffering from acute jaundice, he could not resist them and lost sense. Since then he does not have idea what happened to him, He discovered himself in medical on 14th May when his sense returned back. His wife Budhei said that her husband   had no injury in his body   when he was referred to jail.  She alleged that the jail staff had mercilessly beaten him up causing multiple injury throughout his body.   

The team members verified medical documents  and discussed with Dr. Umesh  Patra, HoD, Haematology Department   over telephone about health  condition of accused.  He said that  the patient was admitted  under unconscious stage. Now  he has regained his sense  after two days of treatment.  He is suffering from multiple disease like liver problem, jaundice and multiple injury. He also apprised the team that it would take minimum 2 months for recovery of his body.

Analysis and Recommendations

It is observed during discussion with Saroj, his wife and Hospital Doctor  that apart from suffering from jaundice,  Saroj was physically fit  at the time of being admitted in Jail. His wife also saw him fine at Choudwar jail on 12th May’2017.     The Team is of the view that the multiple injury around body of Saroj Das proves that he has been systematically physically tortured and beaten up by Warders of Choudwar jail. One of the reasons may be his repeated persuasion to get Rs. 100.00 note given by his wife from Warder. It has exposed     untold story of life of the accused   inside Choudwar jail, torture and inhuman behaviour by jail staff towards them. Ruthless and inhuman torture on Saroj has crossed all the limits and posed serious threat to his life. This is a glaring case of human rights violation in Choudwar jail and also violation of article 21 of the Indian constitution.

In view of it, the Team demands and makes the following recommendation to the State authorities in order to give justice to the poor accused.
1.    Inspector General of Prison, Govt. of Odisha should personally conduct  an inquiry into alleged  ruthless torture   caused to Saroj Das inside Choudwar jail  and take action accordingly in a time-bound manner.

2.    As Saroj Das  is suffering from multiple disease,  a team of doctors of different Department  should be constituted  to examine his health condition from time to time.  he  should be provided adequate treatment for recovery of his health at the earliest.

3.    As Saroj  was only bread-earner of the family, the food security of  his wife and two children in jeopardy. Right to life guaranteed  under Indian Constitution is threatened.  They are starving. The District Collector should take steps  to ensure  food security of the  family.

We the following signatories i.e., Human Rights Activists of the state  draw your kind attention  about abovementioned matter seeking your urgent action.

That,   on 19.5.17, we had conducted a fact-finding enquiry into  the  news published  in Sambad news paper  about brutal attack  and inhuman torture on  Saroj Das, an  accused in Choudwar jail and his hospitalisation on S.C.B. Medical, Cuttack. The incident is that on 9th May,   at 11 PM the Malgodam police arrested Bapi alia Saroj Das of Ranihata Dasa Sahi area of Cuttack town in a police case of 2002 incident in which Saroj was accused. He was produced before Court on 10.5.17 and forwarded to Choudwar Jail.   On 13.5.17, she was informed about hospitalisation of her husband. After going through the news, we had visited S.C.B. Medical to ascertain the fact, reason of torture from accused‘s mouth  and treatment rendered to him, support, if any required  for him in order to provide justice to him and his family. ( the report of the team is attached herewith for reference).

The Team observed that Saroj is having multiple injuries across his body and could not speak and respond properly. His eyes are found yellowish. On query, her wife responded that he was suffering from jaundice before arrest. The team realised that this disease has got aggravated due to lack of proper treatment of the accused in Jail. Then the Team members interacted with Saroj to understand the reason of torture and merciless attack on him.  It is a case of gross violation of human rights of an accused.  He was physically tortured  by Jail staff with ulterior motive which is subject of investigation.  His right to life guaranteed under the constitution has been  violated.  The Superintendent of Choudwar jail  has not followed  Jail Manual and failed  to protect the accused.  As his  physical condition got deteriorated,  he was referred to S.C.B. Medical.  It is proved  the jail authority  also patronises  such type of torture  and physical attack on accused  inside jail.

So, we request the Commission  to issue  the following  direction  to the state Govt. in order to give justice to the accused.

I.          Issue direction to  Inspector General of Prison, Govt. of Odisha  to immediately enquire  into allegation of ruthless torture   caused to Saroj Das inside Choudwar jail  and produce the report along with action taken within 7 days.   

1.    As Saroj Das  is suffering from multiple disease,  direction to be issued  to Superintendent, S.C.B. Medical, Cuttack  to appoint a team of doctors of different Department     to examine his health condition from time to time and  provide adequate treatment for recovery of his health at the earliest.

                       Case No.2807 of 2017 Date : 20.05.2017

Today, Shri Sudhir Mohanty, Advocate, Shri Khirod Rout, Advocate, Odisha High Curt and Shri Pradip Pradhan, HAR and Advisor to NHRC, New Delhi appeared before the Commission and submitted a petition alleging unleashing of inhuman and ruthless torture on UPT namely; Saroj Das in the Circle Jail, Choudwar, Cuttack district.

The above mentioned petitioners had conducted a fact-finding enquiry into the news published in ‘The Sambad’ on 17.5.2017 about the brutal attack and inhuman torture made on Saroj Das, an UTP of Circle Jail, Choudwar and his hospitalisation in the SCB Medical College & Hospital, Cuttack.  The fact-finding team during its visit to the SCB Medical College & Hospital, Cuttack observed that Saroj Das is having  multiple injuries across his body and is not able to speak and respond properly. Apparently, when Saroj Das asked the Jail staff to give him a 100-rupee note which his wife had given to a particular Jail staff to give to him, he neither got his money nor any response from them and ultimately, the Jail staff being enraged over the issue started beating up Saroj Das mercilessly which necessitated his hospitalisation.

The petitioners pray for  issuing necessary direction to the I.G. of Prisons, Odisha to immediately cause an enquiry into the incident and submit his report within seven days. The petitioner also prays for providing the best possible treatment to Saroj Das in the Medical College & Hospital, Cuttack for his speedy recovery and at the same time, the District Magistrate & Collector be directed to provide food security coverage to the family of Saroj Das as he is the only bread winner of his family.

The Commission while viewing the matter seriously directs that Addl. DGP-cum-I.G. of Prisons, Odisha, Bhubaneswar to cause an enquiry into the matter himself and submit a report to the Commission within seven days hence.

At the same time, the I.G. of Police, Central Range, Cuttack is also directed to conduct  an enquiry as to how the UTP Saroj Das sustained so many bodily injuries which are serious in nature while being lodged in the Circle Jail, Choudwar. It is alleged by the petitioners that the said prisoner was beaten up mercilessly by the Jail Staff of the Circle Jail, Choudwar.

The Superintendent, SCB Medical College & Hospital, Cuttack is also directed to provide all possible treatment to the patient and the cost of his treatment be met out of the Odisha State Treartment Fund.  He is also directed to produce all the treatment papers including the injury report of the UTP Saroj Das for perusal of the Commission.

The aforesaid authorities are requested to furnish their respective reports to the Commission within seven days hence.

Recent Trend of Attack on RTI Activists in Odisha

Note on Recent Trend of Attack on RTI Activists in Odisha and failure of police to arrest the culprits

Human Rights Activists and RTI Activists are seen quite vulnerable in Odisha. The trend of brutal attack on RTI Activists, Human Rights Activists and their family members is rising day by day. RTI Activists are always seen at loggerheads with the State administration; corrupt Govt. officials, land mafia, contractors while exposing about corruption, irregularities in Govt. programme, maladministration, favouritism and manipulation in Govt. appointment, malpractice in procurement etc.  Irregularities and illegalities in allotment of land /plot to politicians, bureaucrats, private educational institutions like KIIT, Jagatguru Krupalu  Yoga Trust, Sri Sri Rabi Shankar University,  Ma Ambruta Mayee Devi Trust  by General Administration Department, BDA, CDA, Odisha State Housing Board, IDCO, Illegalities in allotment of mining operation to the companies, pendency of  crores of rupees of water tax and electricity tax against  companies, illegal closure of SIET and OKCL ghotala, illegal occupation of Govt. quarters by former MLAs and Ministers and ex-Govt. employees for years together, black-marketing and adulteration of food items allotted under ICDS, MDM, NREGA Scam, irregularities and corruption in distribution of PDS items   and many other scam has been exposed  by RTI Activists  in the state within period of ten years.  This expose has not only put the Govt. in trouble but has brought to limelight the true character of so-called eminent people of society and their crime. Armed with information obtained through RTI,   Human Rights Activists have taken up various issues by approaching High Courts, Human Rights Commissions, Central Vigilance Commission, CBI and Tribunals like National Green Tribunal seeking justice.  The recent order of National Green Tribunal to Govt. of Odisha to get returned back of 18 acres of forest land illegally acquired by KIIT is one of the best success stories of intervention of Human Rights Activists.

The continuous and constant endeavour of Human Rights Activists and RTI Activists to fight out corruption and maladministration has endangered their life in face of systematic and organised attack of coterie of powerful politicians, bureaucrats and mafias. Within last ten years, Odisha has witnessed brutal attack on 50 Activists and murder of two RTI Activists and many more beaten up severely, harassed, tortured which has gone unnoticed.  In the absence of effective legal mechanism to take prompt action against the culprits and criminal, the RTI Activists and their families remained quite vulnerable in the state. The policy investigations into any allegation of violation of Human Rights Activists are seen far from satisfaction. 

Few recent case studies about Attack on RTI Activists and helplessness of police to arrest the culprit is as follows.


1.       On 24.4.17,    Sri Subas Mohapara, RTI Activist  who was  returning  to his home in the evening  was   stopped  by a gang of byke-borne miscreants  at Khandagiri square and  threatened to be murdered AT GUNPOINT, if he pursues  case  against Achyut Samant of KIIT, Patia, Bhubaneswar.  He filed  the FIR  same day  in Khandagiri  police station accusing  Achyut Samant  behind this threats .  No investigation against Achyut Samant  is yet done  by the police.

2.       On 3.5.17 at around 8.45 pm, a miscreant threw petrol on sister of Pradip Pradhan, State Convener of Odisha Soochana Adhikar Abhijan in front of his residence, Maitree Vihar, Bhubaneswar and ran away. Immediately, Sri Pradhan lodged complaint in Maitree Vihar Police post which is 50 meters away from his residence coming under jurisdiction of Chadrasekhar Pur police station.   The police received the complaint, registered the case as PS Case No.161 dt. 3.5.2017 U/s 448/326/506 IPC and started investigation on same day. Though twelve days passed, the Police has not yet been able to arrest the culprit. However, the police has provided  police protection  to  FAMILY of Pradip Pradhan.

3.       Mr. Sankar Panigrahi, permanent resident of Radharani Pada At-Hospital road, near mausi mandir,Po/Dist-Balangir is engaged in motivating youth in his district to undertake developmental work and also encourages and teaches them to use Right to Information Act to seek information regarding the ongoing developmental work.He is an active member of an unregistered RTI network, namely Odisha Soochana Adikar Abhiyan (OSAA) involved in exposing cases of corruption in government funds earmarked for the implementation of social welfare schemes in Odisha.   Mr. Sankar Panigrahi, had posted in social media (facebook) on date May 9, 2017, “GO BACK NARYAN NAIK”. On May 10, 2017, at about 8.02 PM he received a call from a mobile number +91-7682955014. Without saying anything, the caller started abusing him in filthy language and threatened to kill him in an encounter and rape his wife. Mr. Panigrahi had recorded this conversation. On 12.5.17, Sankar  filed  FIR  in   Bolangir  police station  seeking  investigation into the matter.  The Bolagir Sadar police station   registered FIR no. 0155(IPC-506,507) dt. 15.5.17 and the investigation is going on.    

4.       12.5.17, Sri Keshab Mahakud, physically challenged  and RTI Activist of Nayagarh district  had  come to  Bhubaneswar  to file  complaint  to  Sri Bijayshree Routray, Minister  for Forest and Environment, Govt. of Odisha  about huge corruption  in  Forest Dept. under DFO, Nayagarh.  He met  Minister  in his residence in the evening  and appraised him about  corruption.  While he was on his way to Baramunda by autorickshaw, he was intercepted by  a gang of hooligans at Vanivihar square.  He  was mercilessly beaten up by them. Then  he  went to Saheed Nagar police station  at around 9 pm  and lodged complaint.  The  concerned police asked him to come to police station in the next day.        On 13.5.17, the police  registered  his case  and started investigation.  Nothing has happened till yet.  He had filed RTI to office of DFO, Nayagarh to expose corruption worth crore of rupees by forest officials in collusion with local BJD leaders.  He was threatened to be murdered  by DFO, Nayagarh few days back.  The case has been filed in National Human Rights Commission with case no. 2552/18/28/2017. It deserves to be mentioned here that last year, Sri Mahakud, a Disable person was seriously beaten up and hospitalised for a month in S.C.B.Medical, Cuttack for treatment.

5.       On 16.6.16,  at 11.45 am, Sri Priyabrata Gadnaik, RTI Activist was attacked a gang of 6 hooligans  on  Kaunriapala  river bridge of National Highway 55 of Dhenkanal district . he was forced to jump to river bed and his leg and hand got featured. He was rescued by Ambulance.  Though FIR was lodged in Dhenkanal Sadar police station registered  case no. 251/2016, the police has not yet been able to arrest the culprits. Rather the police helped them to get bail.   On day of attack, Sri Priyabrata was returning  from  Odapada Tahasil  after attending hearing of his first appeal petition filed  before Tahasildar  on denial of information about the PIO. The information sought for was  about details of  stone query leased out to the contractors, revenue collected , illegal stone query operated and action taken. Sri Priyabrata is still fighting for justice.

Updating Status of Investigation into Petrol Attack on Family member of Pradip Pradhan, eminent RTI Activist by Commissionerate Police, Bhubaneswar


On 3.5.17 at around 8.45 pm,  a miscreant threw petrol on sister of Pradip Pradhan, State Convener of Odisha Soochana Adhikar Abhijan and National Working Committee Member of NCPRI (M-9937843482) in front of his residence, Maitree Vihar, Bhubaneswar and ran away. Immediately, Sri Pradhan lodged complaint in Maitree Vihar Police post which is 50 meters away from his residence coming under jurisdiction of Chadrasekhar Pur police station.   The police received the complaint and Sri Deepak Mishra, Inspector-in-Charge reached at residence of Pradip Pradhan at around 9.45 pm to enquire into the matter and visited the spot. The Police registered the case and started investigation on same day. Electronics media immediate aired the news about petrol attack.

On 4.5.17 at around 10 am, two police sub-inspector of Chandrasekhar police station reached in the residence of Sri Pradhan and handed over Copy of FIR. The case was registered  as PS Case No.161 dt. 3.5.2017 U/s 448/326/506 IPC .  Sri Prasad Harichandan, President, Odisha Pradesh Congress Committee  visited residence of Pradip Pradhan  and discussed with him about the incidence  and talked with Police Commissioner to expedite enquiry and arrest the culprit.  At 5 pm, a team of 20 Human Rights Activists and RTI Activists met Police Commissioner in his office and submitted memorandum expressing their concern over the incidence and demanded immediate arrest of the culprit.

From 4th May onwards,  the police made  24 hours security arrangement  around residence of Pradip Pradhan  which is still continuing. 

On 9th May, 2017,  Sri Chandranath Dani, HRD Alert, Sri Pradipta Nayak, Sri Sachikant Pradhan, Sri Pratap Sahu filed  complaint in Odisha Human Rights Commission. On 10.5.17, OHRC registered the case no. 2677 /2017 dt. 9.5.17 and issued notice to Police Commissioner seeking report about status of investigation within 4 weeks and fixed 20.6.17 for hearing.

On 10.5.17,  A team of Civil Society Group Sri Panchanan Kanungo, former Minister, Sri Rabi Das, senior journalist  and Sri Surendra Patra, journalist  met Police commissioner and  discussed with him about status of investigation and demanded immediate arrest of culprits  including security arrangement for Pradip Pradhan.

On 10.5.17, Personal Security Officer was appointed by police Commissionerate to accompany Pradip Pradhan during his visit to different places.  SPO has been asked to report in every day at 9 AM in his residence.

On 12.5.17,  a Civil Society consultation was organised  at Budha Mandir, Bhubaneswar to debate and discuss the issues of impending   attack on RTI Activists  in the state  and finding out  the solution  to ensure security for them.  Accordingly, It was decided to submit a memorandum to Governor, Odisha o 15.5.17 by holding Dharana in front of Raj Bhawan and   seek an appointment with Chief Minister, Odisha for discussion about the problem of Activists.    

Investigation is still going on. Culprit has not yet been arrested.  The efficiency of police Commissionerate has been questionable in public domain.
But struggle of RTI Activists and Human Rights Activists  to expose corruption and irregularities engineered  by bureaucrats, politicians, land mafias like Achyut Samant of KIIT   and to protect human rights of Common people  will gear up in a most co-ordinated  and sophisticated way  to make  Odisha a transparent, corruption-free state.

Classification of Urban Roads by Govt. of Odisha

Few days back, there  was debate in media centring around wild allegation  that  the State Govt.  is going to change name of  State Highways to urban roads in order to help  owner of liquor shops   who have been  debarred from running their shops  within 500 meters away from State Highway or national highways.
Following it, RTI Application was filed to the PIO, Dept. of Works, Govt. of Odisha seeking information about the decisions taken in this regard including copy of the file noting.  On 11.5.16, the PIO has supplied the following information.

A.       On 12.4.17,  the Works Department, Govt. Odisha  has issued  notification no. 5200/W/ROADS/   under the head “ Classification of Urban Roads under Works Department” that Govt. has been pleased to classify all road sections of Works Department  falling within the limits of Municipal corporation, Municipality, NAC, Sub-Divisional headquarters, Block H.Q. & Tahasil Head Quarters as “Urban Roads”. The road shall be improved taking all urban characteristics into account  under state plan for improvement of roads.

This notification does not cover National Highways  passing through urban roads.  

B.     From the file noting it was found that  Chief Engineer, DPI&R  vide his letter dated  9.1.16 218/WORKS/2017-Page-1 has given the following suggestions  for improvement  and maintenance of the Urban roads  by the Works Department in a holistic manner.

i)     All roads  of Works Department  falling within the urban limits like NAC/ Municipal corporation/ Municipality including  Sub-Divisional headquarters, Block H.Q. & Tahasil Head Quarters irrespective  of present nomenclature, may be declared  as “URBAN Roads”. If a part of ODR/MDR/SH falls  under the urban limits, then the same  stretched  be delinked  from its  original classification and be renamed as  an URBAN Road with appropriate nomenclature.

ii)   Dedicated fund provision may be made  in the budget  for improvement  and maintenance  of these URBAN Roads. 
This file was presented  for taking Govt. approval  to declare all stretches  of roads falling in Urban areas  either independently  or as part of ODRs/MGRs/SHs and maintained  in the books of PWD as URBAN Roads.
This suggestion was approved by Chief Minister on 12.1.2017.

On 12.2.17, it was ordered  that Chief Engineer, DPI&R  to be requested  to submit  the list of roads  to Government  for issue of notification.

Disposing of an appeal filed by RTI Activist Subhash Chandra Agrawal, Chief Information Commissioner Radha Krishna Mathur noted that both, the Department of Justice and the Supreme Court CPIO does not hold record of the tradition of summer vacations in the Supreme Court. The appellant, Mr. Agrawal had sought complete information, together with documents related to different Supreme Court holidays and vacations, on account of Holi, Dussehra, Diwali, Christmas, etc. The CPIO had submitted that Supreme Court holidays and vacations are government by Supreme Court Rules, 1966, and the same are available on the Supreme Court website. He submitted that while they do not have record as to the tradition of summer leave, etc., there are 193 working days in total. He further stated that the query submitted by the applicant was in the nature of seeking opinion or comment of the CPIO, which was claimed to be beyond the scope of the provisions of the RTI Act, 2005. The CIC noted that since the matter was transferred by the Department of Justice to the Supreme Court of India, it shows that they both don’t have any record regarding vacations. The CCI then noted that since no department was confident about holding authority of such information, it would not be possible to transfer the application to any other public authority. It was hence observed that steps taken in dealing with the RTI application were “satisfactory” and the appeal disposed of. Reacting to the verdict, Mr. Agrawal said in an Email to LiveLaw, “CIC did not find it fit to revert back RTI petition to Department of Justice for tracing origin of long court-vacations which are said to be continued as some British legacy when British judges in India were privileged with such long court-vacations for preventing them from hot Indian weather and also to facilitate them to visit their homeland in England. This costly facility unfortunately continues in free India even after about seven long decades of independence, that too with long pendency of court-cases. Long-pending recommendation of Law Commission for scrapping long court-vacations, are being continuously ignored. Union Ministry of Law & Justice should immediately scarp any privileged vacations for courts ensuring a common pattern of holidays from Supreme Court to lower courts. Instead of closing work at courts altogether for long court-vacations, judges can be given vacations by rotation like exists system for Professors at medical colleges in Delhi government.”
